10.08 Time for serving affidavits

If someone asks for a new trial and backs up that request with sworn statements (affidavits), the prosecution gets 10 days after being served with the motion to respond with their own sworn statements. This gives both sides a fair chance to put their evidence on the record before the judge decides.

Sometimes 10 days isn't enough time to gather the needed statements. The rule allows for up to 20 extra days if the judge agrees there's a good reason for the delay, or if both sides simply agree in writing to extend the deadline. The judge can also allow the person who asked for the new trial to file a reply to whatever the prosecution submitted, giving them one more chance to respond before a decision is made.
