13.04 Application of Civil Rules to criminal procedure

Criminal cases mostly follow their own set of rules, but sometimes those rules don't cover every situation that comes up in court. When that happens, judges can borrow rules from civil court cases to fill in the gaps.

This only works if the civil rule doesn't clash with anything already spelled out in the criminal rules. If a criminal rule already covers a topic, that rule wins. Civil rules only step in when the criminal rules are silent on an issue.
