Rule 2-9 Substitution of Parties

If someone involved in a court appeal dies, becomes legally incapacitated, or a business changes hands while the case is still going on, the case doesn't just end. Instead, the right person needs to be officially swapped in to take their place in the appeal. This process is called "substitution of parties."

For appeals in Louisiana, the specific steps for doing this are found in the state's Code of Civil Procedure, articles 801 through 807. These articles spell out things like who can ask for the substitution, how much time you have to do it, and what paperwork needs to be filed with the court.

In short, this rule doesn't create new steps for substituting parties. It simply points to the existing law that already covers this situation and says those same rules apply when a case is on appeal.
