Rule 4-1 Applications for Writs

If you're asking a Court of Appeal to review a lower court's decision through a "writ application," you need to file it with the court clerk. Unless you're filing electronically, you must submit the original application plus copies. Each Court of Appeal sets its own rule for how many copies are needed, so check the local rules for the specific court handling your case.

Any written argument (called a brief) supporting your writ application must be turned in at the same time as the application itself. If the other side wants to argue against your application, they need to file their opposing brief before the court makes a decision. The deadline for that opposing brief depends on the local rules of that Court of Appeal, or on a deadline the court sets for that specific case.
