XIX App. B R. 5 Subpoenas Under L.R.S. 13:3661

When someone in a lawyer discipline case needs to subpoena a witness (like an expert), the law requires certain fees to be paid to that witness. This rule explains how that payment process works.

The lawyer being investigated (the respondent) has to set aside the required money in a trust or escrow account ahead of time. This makes sure the funds are available and properly handled.

The person or side who actually requests the subpoena is the one responsible for paying the witness. That payment has to happen at the time of the hearing the witness is being called for. In short, requesting a subpoena comes with a duty to pay the witness fees on time, and the money needs to be set aside properly beforehand.
