Art. 1012 Authority of the court

When someone asks the court to release confidential records (like juvenile records), the judge does not have to say yes right away. If the person asking has not shown a strong, real need for the information, the judge can turn down the request.

If the judge is thinking about granting the request, they must first schedule a hearing on it. The judge can also appoint someone called a curator ad hoc, who acts as a stand-in to represent the interests of the person whose records are involved, especially if that person cannot represent themselves in this process.

This process gives the court a chance to weigh the request carefully before opening up private records. It protects the privacy of the person connected to the records while still allowing access when there is a good enough reason.
