Art. 1025.3 Failure to appear at appearance to answer

If a parent gets proper notice to appear in court and answer a petition to terminate their parental rights, but they don't show up, the court doesn't just let the case stall. Instead, the judge will go ahead and schedule the actual termination hearing.

The court still has to try to let the parent know about this new hearing date. It does this by mailing notice through registered or certified mail, with a return receipt requested, sent directly to the parent. This means the court needs proof that the mail was sent and delivered specifically to that person, even though the parent already missed their first chance to appear.

In short, missing the first court date doesn't stop the case. It moves forward toward a termination hearing, and the parent gets one more mailed notice telling them when that hearing will happen.
