Art. 104 Applicability of Code of Criminal Procedure; Code of Civil Procedure

If a court case involving kids doesn't have clear steps written out in the Children's Code or another law, the court has to look somewhere else for guidance on how to proceed. Which set of rules it uses depends on the type of case.

For delinquency cases (when a child is accused of breaking the law) or when an adult is being tried for a crime, the court follows the Code of Criminal Procedure. This is the same rulebook used in regular criminal court cases.

For every other kind of case, like custody, child support, or abuse and neglect cases, the court follows the Code of Civil Procedure. These are the rules normally used in non-criminal court matters.

Basically, this rule fills in the gaps. It makes sure there's always a clear set of procedures to follow, even if the Children's Code itself doesn't spell out every single step for a specific situation.
