Art. 1107.4 Filing of intent to surrender for adoption

When a birth parent plans to give up a child for adoption, someone has to officially file that intent with the right court. This job falls on either the adoption agency handling the case or the lawyer representing the adoptive parents.

The filing can't just go to any court. It has to go to a court that has proper authority over the case, based on the rules set out in Article 1180. This usually means the court connected to where the child, birth parent, or adoptive parents live, depending on the situation.

This step matters because it starts the legal process for the adoption. Without this filing happening correctly and in the right court, the adoption process can't move forward the way it's supposed to.
