Art. 1110 Nature of authority

When one parent decides to surrender their child for adoption, that decision only affects that parent's own rights. It does not touch or change the rights of the child's other parent.

This means if one parent signs away their parental rights, the other parent still has full legal rights to the child. That other parent's ability to make decisions for the child, spend time with them, or fight for custody stays exactly the same. One parent's choice cannot take away or reduce what belongs to the other parent.

In practice, this protects parents from losing their rights because of someone else's decision. If you are a parent and the other parent surrenders the child for adoption, you do not automatically lose your own parental rights. Your legal connection to your child stays in place unless a separate legal process addresses your rights specifically.
