Art. 1116 Agency adoption; acceptance by agency

Here's what this rule means in plain terms:

When parents give up a child for adoption through an agency, the agency must formally accept that decision in writing. This isn't just a simple signature or informal note. The acceptance has to be done as an "authentic act," which means it follows specific legal formalities, usually involving a notary and witnesses, similar to how other important legal documents are signed.

Until the agency accepts the surrender this way, the surrender doesn't count as final or official. Both the parent giving up the child and the agency need to complete this step properly for the adoption process to move forward legally. This protects everyone involved by making sure there's clear, verified proof that the agency agreed to take responsibility for the child.
