Art. 115 Oath or affirmation in juvenile proceedings

Anyone who testifies in a juvenile court case has to promise to tell the truth. This is usually done by swearing an oath, but a person can also just affirm they will be honest if they have religious or personal objections to swearing an oath.

There's a special rule for children who testify. Kids don't always have to swear an oath or make a formal affirmation. Instead, the judge just needs to be satisfied that the child understands they have to tell the truth. The judge might ask the child some simple questions to check this, like asking what happens if someone tells a lie, or asking the child to promise to be honest. This makes it easier for young children to testify without getting confused or scared by formal legal language they might not understand.
