Art. 1179 Appeal

If a court says no to an adoptive placement, the person who wanted to move forward with the adoption can appeal that decision. This appeal goes to the court of appeal, and that court will take a fresh look at the whole case instead of just reviewing what the lower court decided. The higher court will use the same set of standards from Article 1177 to make its own decision.

This type of appeal moves fast and stays private. The judges hear it in chambers, which means it's not open to the public. They also handle it in a summary way, meaning they skip a lot of the usual formal steps to save time. The law requires the court to hear the appeal within 48 hours after it's filed, so families get an answer quickly instead of waiting weeks or months.
