Art. 1303.2 Proceeding by minor parent

If you're a minor (someone under 18) and you have a child, you have the legal right to bring a court case on behalf of your child. You don't need to wait until you turn 18 to protect your child's interests in court.

A guardian or other legal representative can also file a case for the minor parent's child if needed. This means the child still has someone who can act for them in court, whether that's the young parent themselves or another adult who has legal authority to help.

This rule makes sure a child isn't left without someone to speak up for them just because their parent is still a minor. It gives young parents the same ability as adult parents to take legal action when it comes to protecting or benefiting their child.
