Art. 1457 Right of habeas corpus

If you believe a court order about a child is wrong or needs to change, you still have the right to file a habeas corpus petition. This part of the law does not take that right away from you.

A habeas corpus petition is a legal request asking a judge to review whether someone is being held or kept from a person unfairly, such as a child being kept from a parent or guardian. This rule makes clear that no other part of this law can block you from filing one.

You can also use this right if things have changed since the last court order. For example, if circumstances are different now than when the original order was made, you can still ask the court to look at the case again through a habeas corpus petition.
