Art. 1462 Objection to admission by the minor who has been admitted

If a minor is 16 or older and was admitted to a treatment facility, that minor has the right to object to being there. This means the young person can speak up and say they don't want to stay, even if someone else agreed to have them admitted.

If the minor tells any staff member that they want to object, the staff must help them prepare and turn in that objection. Staff can't ignore the request or make the process difficult. The facility is required to give the minor real help putting the objection in writing or submitting it properly.

Once the facility gets the objection, the director has 72 hours to release the minor. The only way the facility can keep the minor longer is if they start formal legal proceedings under Chapter 7 or Chapter 9 of this law. Without that legal step, the minor must be let go within three days of raising the objection.
