Art. 316 Improper venue; transfer

If a case gets filed in the wrong court, the judge has two options. The judge can throw out the case, or send it to the correct court where it should have been filed in the first place.

This rule exists because cases need to be handled in the right location. Courts have specific geographic areas they cover, and a case filed in the wrong area needs to be fixed before it can move forward. Rather than making people start over completely, the judge can simply move the case to the right court so it can continue.
