Art. 665 Burden of proof

When the state brings a case under this rule, it has to prove its claims. This is called the "burden of proof," and it means the state cannot just make accusations. It has to back them up with real evidence.

The standard the state must meet is called "preponderance of the evidence." This simply means the state has to show that its claims are more likely true than not true. Think of it like a scale. If the evidence tips the scale even slightly in the state's favor, that's enough to meet this standard.

This is a lower bar than what's used in criminal cases, where the standard is "beyond a reasonable doubt." That higher standard requires much stronger proof. Here, the state just needs to show that its version of events is more likely correct than incorrect, based on the evidence presented in court.
