Art. 680 Disposition hearing; rights of parties; evidence

When a judge decides what happens after a child has been found to need court supervision, everyone involved gets certain basic rights. Parents and other parties can testify, question witnesses on the other side, bring in their own evidence and witnesses, and have a lawyer represent them during this stage.

The judge doesn't just make this decision based on gut feeling. Before deciding, the judge has to look at the predisposition investigation report, the case plan, any mental health evaluations, and other evidence that both sides bring forward. This helps the judge get a full picture of the family's situation.

One important thing to know is that the rules for evidence are more relaxed at this hearing than they were earlier in the case. During the adjudication hearing (where the court decided if something actually happened), certain evidence might have been off-limits. But at this disposition stage, the judge can consider things that wouldn't normally be allowed, since the goal now is figuring out the best path forward for the child, not proving what happened.
