Art. 764 Dismissal of petition

If the district attorney asks the court to drop a petition, the judge must grant that request. The court doesn't get to second-guess the district attorney's decision or keep the case going against their wishes.

This gives the district attorney full control over whether a case moves forward once they decide to end it. If they file a motion to dismiss, the judge's only job is to approve it and close out the petition. There's no room for the court to weigh in on whether dismissal is the right call.

For families involved in a case, this means that if the district attorney decides not to pursue the matter anymore, the case will end. You won't need to convince a judge separately, and the judge won't be able to force the case to continue even if they might have handled it differently.
