Art. 778 Disposition hearing; evidence

Before deciding what happens to a child in a case like this, the judge can look at more than just the evidence presented at trial. The judge can review a report that was prepared ahead of time looking into the child's background and situation. The judge can also look at any mental health evaluations that were done, along with other evidence brought forward by the child, the child's parent or caretaker, or the state.

This means the rules are more relaxed at this stage. Evidence that would not have been allowed during the trial phase (called the adjudication hearing) can still be considered here. The goal is to give the judge a full picture of the child's needs so they can make a fair decision about what should happen next, whether that means probation, placement, treatment, or another outcome.
