Art. 788 Service of motion to modify

If someone files a motion to ask the court to change a child's custody arrangement or care plan, certain people must get a copy of that motion. This includes the child affected by the case, the person taking care of the child, the district attorney, and any organization or agency that provides services related to the child. If custody has been given to a specific person, institution, or agency, they must also receive a copy.

The copy must be delivered the same way the original petition was served when the case first started. This means the court follows the same formal delivery rules used at the beginning of the case, so everyone involved stays informed and has a fair chance to respond before any changes are made.
