Art. 806 Change of venue; improper venue

If a case gets filed in the wrong court, that court has options for fixing the problem. This can happen if a family files paperwork in a court that isn't set up to handle their type of case or their area.

The judge can raise this issue on their own, or someone involved in the case can ask for it to be looked at by filing a written request. Either way, both sides get a chance to speak up about it at a hearing before anything happens.

After hearing from everyone, the judge decides what to do next. The judge can either throw out the case completely, or send it to the correct court that should be handling it. This makes sure cases end up where they belong, in front of the right court that has the authority to make decisions about them.
