Art. 812 Taking child into custody

Police or juvenile authorities can take a child into custody in two ways. A judge can issue a court order allowing it, or officers can use the same rules that apply to adult arrests. Either method is a legal way to place a child into custody.

Even though the process may look like an arrest, the law says it is officially not called an "arrest" for most purposes. There is one important exception: if someone wants to challenge whether taking the child into custody was constitutional, courts will treat it like an arrest for that specific legal question. This means a child (or their family) can still argue that their constitutional rights were violated during the process, even though the law normally avoids labeling it an arrest.
