Art. 842 Authority to file petition

A delinquency case against a child starts when someone files a formal petition with the court. The district attorney has the power to file this petition on their own, without needing special permission from a judge first.

Other people can also file a petition, but only if the court has given them authority to do so. Before filing, they need a good reason to believe the child actually committed a delinquent act. This means the case can't move forward on a guess or a hunch. There has to be real evidence pointing to the child breaking the law.
