Art. 864 Places of detention; before and after transfer

This rule explains where a child can be held before and after a judge decides to move their case to adult court. Before that decision happens, the child must stay in a place that is approved for holding kids before their case is decided, following the rules already set out for juvenile detention.

Once a judge signs an order transferring the child's case to adult court, things change. The child can then be held in a regular adult jail or detention facility, the same place used for adults awaiting trial. At that point, the child also gains the right to ask the adult criminal court for things like a preliminary hearing and bail, along with any other protections adults get under Louisiana's criminal court rules.

In short, this rule marks the turning point in a case. Before transfer, the child is treated under juvenile detention rules. After transfer, the child is treated more like an adult defendant, including where they are held and what legal rights they can ask for in court.
