Art. 870 Motion for a bill of particulars

If a child is accused of committing a delinquent act, the child or their lawyer can ask the court for more details about the charges. The court can also decide on its own to ask for these details. This request is called a motion for a bill of particulars. It basically asks the prosecutor to explain more clearly what the child is accused of doing and why.

Once the prosecutor writes up this bill of particulars, it gets filed with the court clerk. A copy also has to be given to the child or the child's lawyer, so they know exactly what information the prosecutor provided.

The court can also ask for updated or additional details later on, as long as it happens before the adjudication hearing starts. This gives everyone a chance to make sure the charges are clear before the hearing where the court decides if the child committed the act.
