Art. 876 Dismissal of petition

If the district attorney asks the court to drop the petition, the court has to grant that request. The judge doesn't get to weigh in on whether it's a good idea or overrule the decision. Once the district attorney files the motion to dismiss, the case is over.

This gives the district attorney a lot of control over whether a case moves forward. If prosecutors decide not to pursue the matter anymore, for whatever reason, they can end it simply by asking the court to dismiss it. The judge's role here is just to carry out that decision, not to second-guess it.
