Art. 883 Burden of proof

When a child is accused of committing a delinquent act, the state has to prove its case beyond a reasonable doubt. This is the same strict standard used in adult criminal trials. The court cannot decide a child is delinquent just because it seems likely they did something wrong. The evidence has to be strong enough to leave no reasonable doubt in the judge's mind.

This rule protects kids from being labeled delinquent based on weak or shaky evidence. If the state cannot meet this high bar, the court must not find the child delinquent, even if there is some evidence pointing to guilt. The child gets the benefit of the doubt unless the proof is clear and convincing beyond question.
