Art. 1065 Reconventional demand exceeding principal demand

When someone gets sued, they can file their own counterclaim against the person suing them. This rule says that counterclaim does not have to cancel out or reduce what the original lawsuit is asking for. The two claims can stand on their own, separate from each other.

The rule also says the counterclaim can ask for more money or more relief than what the original lawsuit demanded. In other words, if you get sued for $5,000, you can file a counterclaim asking for $50,000 if you believe that is what you are owed. The amount in your counterclaim is not limited by the amount in the original lawsuit against you.

This gives people more freedom to bring their full claim to court, even if it is much bigger than the case that was originally filed against them.
