Art. 1236 Service on clerical employees of physicians

If you need to formally deliver legal papers to a doctor who isn't part of the lawsuit (for example, to get medical records or testimony), you don't have to hand the papers directly to the doctor. Instead, you can give them to any clerical worker at the doctor's office, like a receptionist or office assistant.

This makes it easier to serve doctors with legal paperwork, since doctors are often busy seeing patients and hard to reach in person. As long as the papers are left with someone who works in the office handling clerical tasks, the service counts as valid under the law.

This rule only applies when the doctor is not a party to the case. If the doctor is being sued or is suing someone, different rules for service would apply.
