Art. 1432 Use of deposition

If someone takes a deposition ahead of time to save testimony for a future lawsuit, that deposition doesn't just disappear once it's recorded. This rule says that deposition can later be used in a different court case, as long as the new case deals with the same basic subject matter as the original one.

This matters because sometimes people need to get testimony on record before a lawsuit even starts, maybe because a witness is sick, elderly, or might not be around later. This rule protects that early testimony so it isn't wasted. If a real court case does happen later, that saved deposition can be brought in as evidence, following the same rules that normally apply to using depositions in court, which are laid out in Article 1450.
