Art. 1603 Motion for continuance

If you want to ask the court to postpone a hearing or trial, you need to file what's called a motion for a continuance. This motion has to clearly state the reasons why you're asking for more time. You can't just ask for a delay without explaining why you need it.

If you put your request in writing, it also has to follow the rules laid out in Article 863. That article covers general requirements for how documents get signed and filed with the court, including certifying that your request is made in good faith and isn't just a stalling tactic.

In short, this rule makes sure that anyone asking for a delay has a real reason for it, and that reason has to be spelled out for the judge to consider.
