Art. 1974 Delay for applying for new trial

If you lose part or all of your case and want to ask the court for a new trial, you have to act fast. You get seven days to file that request, starting from when you receive official notice of the judgment. This notice might come by mail from the court clerk, be handed to you in the courtroom, or be delivered by the sheriff.

When counting these seven days, you skip legal holidays. So if a holiday falls during that week, it doesn't count as one of your days, and your deadline gets pushed out.

This deadline matters a lot. If you miss it, you likely lose your chance to ask for a new trial through this process. That's why it's important to know exactly when you received notice of the judgment, since that date starts the clock running on your seven days.
