Art. 2455 Costs

When a creditor asks the court to examine a debtor about their finances (usually to find assets to collect a debt), the debtor normally has to pay the court costs for this process. This makes sense because the debtor is the one who owes money and hasn't paid it.

However, there's an exception. If the court decides the creditor didn't really need to use this process, the judge can make the creditor pay the costs instead. This protects debtors from creditors who might misuse this legal tool without good reason, forcing people through unnecessary court proceedings.

In short, the person who loses money in this situation depends on whether the examination was actually necessary. If it was a reasonable step to collect a legitimate debt, the debtor pays. If the creditor jumped to this remedy without good cause, they bear the cost themselves.
