If you want to force the sale of property because someone owes money secured by a mortgage or similar legal claim, you have to start the process by filing a written request with the court called a petition. This petition needs to clearly ask the court to seize the property and sell it to pay off the debt.
Your petition also has to follow the standard formatting and content rules that apply to all petitions in Louisiana courts. On top of that, you must attach certain documents to back up your request, like the mortgage papers or other proof showing you have the right to collect the debt. These required documents are listed in a separate rule (Article 2635).
Basically, this rule sets up the first step for someone trying to collect on a debt by selling the property that was used as collateral. You cannot just ask the court informally. You need a proper petition with the right paperwork attached before the court will move forward with seizing and selling the property.
