Art. 2638 Order for issuance of writ of seizure and sale

When someone owes money and has pledged property as collateral (like through a mortgage or similar legal claim), the person suing to collect that debt can ask the court for permission to have that property seized and sold. If the court agrees that the person suing has a valid right to do this, the judge will order the sheriff to take the property and sell it.

This process lets a creditor collect what they're owed by forcing the sale of the property tied to the debt. The sheriff carries out the actual seizure and sale, following the specific request made in court and the standard legal process required by law.

For property owners, this means that if you've put up property as security for a loan or debt and you don't pay, the court can authorize its sale without a lengthy separate trial on the underlying debt. The court simply confirms that the creditor has the legal right to collect this way, then directs the sheriff to move forward with taking and selling the property.
