Art. 2673 Proceeding against legal representative

If someone owes a debt secured by property, and that person has died or their property is now being handled by an executor, administrator, or another legal representative, the case can be filed directly against that representative. The person filing the case does not need to name or involve anyone else.

This makes things simpler when the original debtor can't act on their own behalf anymore. Instead of tracking down heirs, family members, or other interested parties, the creditor can move forward with the legal representative alone. That representative stands in for the debtor and handles the case on their behalf.
