Art. 2754 Security otherwise required

If you want a court to stop a sheriff's sale or seizure through a temporary restraining order or preliminary injunction, you usually have to put up security money first. This means you cannot just ask the court to halt the sale without backing up your request with a financial guarantee.

The amount and type of security you need to provide follows the rules laid out in Article 3610. This security protects the other side in case it turns out your request to stop the sale was wrong or unfair. If the court later decides the seizure should have gone forward, this security money can help cover any losses the other party suffered because of the delay.

There is one exception. Article 2753 spells out a specific situation where you do not need to provide this security. If your case falls under that exception, you can skip this requirement. Otherwise, expect to pay security money as a standard part of trying to stop a seizure and sale.
