Art. 2902 Opposition to petition for probate

If someone wants to challenge a will during the probate process, they have to follow specific steps. They must file a formal objection that meets the requirements of Article 2972, and this objection has to clearly state the specific reasons why they believe the will is invalid. Simply saying the will is wrong isn't enough. The person must spell out the legal grounds for their challenge, such as claims that the will wasn't properly signed, the person who made it wasn't mentally capable, or someone pressured them into making it.

Once this objection is written up, it must be officially delivered to the person who is asking the court to approve the will, known as the petitioner. This gives that person fair notice that their request is being challenged and lets them know exactly what issues they'll need to address in court. This process makes sure that will disputes are handled fairly, with both sides knowing what the disagreement is about before the case moves forward.
