Art. 3003 Same; evidence of allegations of petition for possession

When someone asks the court to be recognized as the rightful owner of property left behind by a deceased person, they have to prove certain basic facts before the court will grant that request. This rule explains how those facts get proven.

Specifically, the person filing the petition needs to show proof of the death, proof that the court has authority to handle the case, proof of marriage if a spouse is involved, and proof of how the petitioners are related to the person who died. Instead of creating new rules for how to prove these things, this rule says to follow the same process already laid out in Articles 2821 through 2823, which cover succession proceedings.

In practical terms, this means the same kind of documentation and evidence used in other estate cases, like death certificates, marriage certificates, and proof of family relationships, will also work here. The court is not asking for anything unusual. It just wants confirmation that the basic facts of the case are true before recognizing someone's right to the property.
