Art. 3035 Particular legatee may demand security for delivery of legacy; administration in default of security

If you were left a specific item or gift in a will (called a particular legacy), and a court already ruled that you should get it, but you still haven't received it, you have options. You can ask the person who inherits everything else in the estate (the residuary legatee) to put up security. This means they promise or guarantee that they will actually hand over what you're owed.

If that person refuses to provide this security, you can ask the court to appoint someone to formally administer the estate instead. This gives you a way to make sure your gift actually gets delivered, rather than just waiting and hoping the other person follows through on their own.

This rule basically protects people who are owed a specific gift from a will when the person in charge of the estate isn't cooperating. It gives you a legal path to either get a guarantee or force a more formal process to make sure you receive what the court already said belongs to you.
