Art. 3261 Purpose of sale

When someone dies and their estate needs to sell property, the person handling the estate (called a succession representative) can't just sell things on their own. They need the court's permission first.

Once the court gives approval, the representative can sell property from the estate. This is often done to pay off debts the deceased person owed, or to make sure people named in the will get what they were promised. The representative can also sell property for other valid reasons, as long as the court agrees to it.

This rule protects everyone involved. It makes sure property isn't sold off without a good reason and proper oversight. Anyone with a stake in the estate, like heirs or creditors, can count on the court reviewing the sale before it happens.
