Art. 3271 Petition; order

If you're handling someone's estate and want to sell property from that estate at a public auction, you need to file a written request with the court first. This request has to describe the property you want to sell and explain why selling it makes sense.

The judge will look at your request and decide if selling the property is a good idea for the estate. If the judge agrees it's in everyone's best interest, they'll issue an order letting you move forward with the auction. But before the sale can happen, the auction has to be publicly announced or advertised, so people know it's happening.

This process exists to protect the estate and the people who have a stake in it, like heirs or creditors. It makes sure property isn't sold off without a good reason and without the court checking that the sale actually benefits the estate.
