Art. 3353 Legacy to executor

If someone is named executor of a will and they also inherit something from that will (like money or property), they can still get paid for their work as executor. The will would have to specifically say they can't be paid in order to block this.

However, there's a limit. Louisiana law caps how much of an estate a person can inherit if the deceased person had children or other close family members with protected inheritance rights (this is called the "disposable portion"). If the executor's inheritance plus their executor pay would go over that legal limit, they only get the amount allowed under the limit. They can't collect both the full inheritance and full executor pay if it pushes past what the law allows.
