Art. 3395 Disposition of movables not accepted by heir

When someone dies and leaves behind physical property (like furniture, vehicles, or other personal belongings), the person handling the estate might run into a problem. Sometimes an heir, a person named in the will, or a creditor doesn't want to take the property, or simply can't accept it and sign for it. Maybe the item isn't wanted, or the person can't be reached, or there's some other holdup.

When this happens, the estate representative doesn't have to just sit there stuck with the property. They can ask the court for guidance on what to do with it. The court will then decide how the property should be handled, whether that means selling it, storing it, giving it to someone else, or some other solution.

This rule basically gives the estate representative a way to move forward when property gets stuck in limbo. Instead of leaving items sitting around with no one willing to claim them, the court steps in to make a decision so the estate can be settled properly.
