Art. 3396.16 Enforcement of claims against estate

If you are owed money or something else by an estate, you can go after the independent administrator to get what you are owed. You use the same legal steps you would normally use to enforce that kind of claim under Louisiana law. The fact that the estate has an independent administrator, instead of a regular one, does not change your rights or take away your ability to collect what you are owed.

In short, this rule makes sure that having an independent administrator does not put creditors or claimants at a disadvantage. You still have the same tools available to pursue payment or make sure an obligation is carried out, just like you would with any other type of estate administration.
