Art. 3403 Capacity to sue

If someone dies and a person is appointed elsewhere (in another state) to handle their estate, that person cannot go to court in Louisiana on behalf of the estate right away. They must first get approved by a Louisiana court before they can file or take part in a lawsuit here.

This means an out-of-state executor or administrator needs to complete a separate legal process in Louisiana first. Only after a Louisiana court recognizes their authority can they act on behalf of the estate in Louisiana courts. There are some exceptions if another law specifically allows it, but generally this qualification step cannot be skipped.

This rule exists to make sure Louisiana courts have proper oversight when an estate's business involves the state. It protects people dealing with the estate by requiring a clear legal process before someone can act on the estate's behalf here.
