Art. 3602 Preliminary injunction; notice; hearing

Before a judge can issue a preliminary injunction, the other side must be told about it and given a chance to respond in court. A judge cannot grant this type of order without first letting the opposing party know what is happening and giving them a fair shot to argue their side.

Once someone asks for a preliminary injunction, the court has to schedule a hearing within a specific window of time. The hearing must happen at least two days after the other side gets notice, but no later than ten days after that notice is served. This gives the other party enough time to prepare, while also making sure the case moves forward quickly instead of dragging on.
