Art. 3742 Notice of seizure

If someone owes a debt that's backed by a legal or judicial mortgage on a piece of property, and that property gets sold or transferred to someone new, this rule covers what happens when the creditor decides to seize the property.

The creditor who is seizing the property must make sure the sheriff delivers notice of the seizure to two people: the original person who owed the debt, and whoever owns the property now. Both people need to be officially told that the seizure is happening, even though only one of them (the new owner) may currently hold the property.

This protects both parties. The original debtor stays informed about action being taken related to their old debt. The current owner, who may have had nothing to do with the original debt, learns that their property is caught up in someone else's legal problem and can respond accordingly.
